Terms of Service

These Terms of Service ("Terms") govern your use of the Pālan driver behaviour intelligence platform ("Service"), operated by Skotantrx ("we", "us", "our"), a micro enterprise registered under UDYAM-TS-09-0272384, Hyderabad, Telangana, India.

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

• You must be at least 18 years of age to use this Service
• To record a trip, the driver must hold a valid driving licence (DL), or a valid learner's licence (LLR) and drive with a supervisor who holds a DL, with "L" plates shown, as the Central Motor Vehicles Rules require (rule 3)
• By registering, you confirm that you meet these requirements

2. Account responsibilities

• You are responsible for maintaining the confidentiality of your login credentials
• You are responsible for all activity under your account
• You must provide accurate information during registration, including your own licence number. Do not enter another person's licence number as yours, and enter a driver's or supervisor's licence only with their knowledge
• You must notify us immediately if you suspect unauthorised access to your account
• One person may hold one personal account. Business accounts are limited to one per organisation

3. The Service

Pālan provides:

• Dashcam video recording during driving trips
• Automated analysis of driving against road signs, traffic signals, speed limits and smooth-driving measures (lane analysis is in beta and not part of the score)
• Trip reports, a Pālan Score that belongs to your licence, a breakdown by road rule and advice on driving better
• GPS-based trip mapping and speed analysis
• Your vehicles and the drivers you add
• Your score, summary and advice in English, Hindi or Telugu

4. Important disclaimers

• Observations, not findings: Pālan's observations are automated and advisory, meant to help you drive more safely. They are not a finding that any law was broken. Only a competent authority (traffic police, RTO, or a court) can decide that. Words such as "possible", "dangerous", "unsafe" and "caution" describe road-safety risk, not guilt
• Translations: Hindi and Telugu text is provided for convenience. If it differs from the English, the English applies
• AI limitations: Our AI models analyse driving behaviour with reasonable accuracy but are not infallible. Detection results may contain errors due to camera quality, lighting, weather, or road conditions
• Not real-time guidance: Pālan analyses trips after the fact. Do not rely on the app for real-time driving decisions
• Safe driving: Always follow traffic rules and drive safely. Pālan does not replace your responsibility as a driver
• Phone mounting: If using Pālan for dashcam recording, ensure your phone is securely mounted. Do not operate the app while driving

5. Acceptable use

You agree NOT to:

• Use the Service for any unlawful purpose
• Record trips without the knowledge of vehicle occupants, or record a trip for a driver without their knowledge
• Record a learner's trip without a licensed supervisor and "L" plates
• Photograph or claim a vehicle's number plate when you are not driving or responsible for that vehicle
• Share or distribute raw dashcam footage containing identifiable faces or number plates (our reports blur these automatically)
• Attempt to reverse-engineer, decompile, or extract our AI models, algorithms, or source code
• Use the Service to conduct surveillance on other individuals
• Create multiple accounts to circumvent usage limits
• Interfere with the Service's operation or security
• Use automated tools to access the Service (except through our published API)

6. Data and privacy

• Your use of the Service is also governed by our Privacy Policy
• Raw trip video is retained for 10 days and then permanently deleted
• If you need a copy of a raw video, ask us within those 10 days; after that it cannot be recovered
• Processed reports and GPS data are retained for 1 year
• You may delete your account and all associated data at any time

7. Intellectual property

• Our IP: The Pālan platform, including its AI models, algorithms, software, design, and branding, is the intellectual property of Skotantrx. All rights reserved
• Your data: You retain ownership of your personal data, trip recordings, and GPS data. By using the Service, you grant us a limited licence to process this data solely for providing the Service
• Reports and score: trip reports and your Pālan Score are generated automatically from your data. You may use and share your own reports and score freely
• Feedback: Any suggestions or feedback you provide may be used by us to improve the Service without obligation to you

8. API usage (Sign Detection API)

If you access our sign detection API (via RapidAPI or direct access):

• API usage is subject to rate limits and fair use
• You may not use the API to build a competing service
• API responses are for your internal use; do not redistribute our model outputs as a standalone product
• We reserve the right to modify or discontinue API access with reasonable notice

9. Service availability

• We aim to keep the Service available 24/7 but do not guarantee uninterrupted access
• We may perform maintenance, updates, or modifications that temporarily affect availability
• We are not liable for any loss arising from service interruptions

You agree to indemnify and hold harmless Skotantrx from any claims, damages, or expenses arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any applicable law or regulation
• Any content you upload or share through the Service

12. Termination

• By you: You may delete your account at any time. All your data will be deleted within 30 days
• By us: We may suspend or terminate your account if you violate these Terms, with notice where practicable
• Upon termination, your right to use the Service ceases immediately
• Sections on IP, liability, indemnification, and governing law survive termination

13. Changes to these Terms

We may update these Terms from time to time. We will notify you of material changes via the app or email at least 15 days before they take effect. Continued use after the effective date constitutes acceptance.

14. Governing law and disputes

• These Terms are governed by the laws of India
• Any disputes shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana
• Before filing a legal claim, you agree to attempt resolution through our Grievance Officer
